1. About the eSafety Commissioner
The eSafety Commissioner ("eSafety") is Australia's independent statutory regulator for online safety. eSafety operates under the Online Safety Act 2021 (Cth) and is responsible for the implementation and enforcement of Australia's online safety laws.
Role
eSafety's role is to help safeguard Australians at risk of online harms and to promote safer, more positive online experiences. The Online Safety Act 2021 gives eSafety the authority to protect Australians from online harms, hold service providers accountable for user safety, and promote more positive digital spaces.
Functions
eSafety's principal functions include:
- investigating complaints from individuals and acting to stop, remove or limit the impact of cyberbullying of children, adult cyber abuse, image-based abuse (the non-consensual sharing or threatened sharing of intimate images or videos), and illegal and restricted online content (including child sexual exploitation material and pro-terror material);
- overseeing the Basic Online Safety Expectations applicable to online service providers;
- registering and enforcing industry codes and determining industry standards for managing illegal and restricted online content (including the DIS Standard 2024 applicable to this Service);
- issuing transparency, reporting and information-gathering notices to providers, and taking enforcement action (including civil penalty proceedings before the Federal Court) for non-compliance;
- conducting research, education and prevention programs to support online safety in Australia.
